Welcome to TrippApps. These Terms of Service (the “Terms”) are a binding agreement between you and TrippApps (“TrippApps,” “we,” “us,” or “our”) and govern your use of the TrippApps website, trip-planning tools, and mobile applications, together with all related features and content (collectively, the “Services”). Please read them carefully. By creating an account, checking the box to accept these Terms, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Plan with care. TrippApps is a travel-planning aid, not a safety device or a substitute for your own judgment. Every route, distance, arrival time, fuel or charging estimate, and stop location is an estimate only. You are responsible for verifying real-world conditions and for traveling safely. See Section 4 for the full disclaimer.
You must be at least 18 years old, or the age of legal majority in your place of residence, to use the Services. By using the Services you represent that you meet this requirement and that you are able to enter into a binding agreement. If you use the Services on behalf of another person or an organization, you represent that you are authorized to accept these Terms on their behalf.
Some features require an account. You agree to provide accurate information, to keep it up to date, and to keep your login credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly at support@trippapps.com if you believe your account has been compromised. You may close your account at any time.
TrippApps helps you plan road trips — by motorcycle, car, van, truck, or electric vehicle — by mapping routes and estimating refueling or charging stops, meals, lodging, and multi-day pacing. The Services rely on information you provide (such as your vehicle’s range, fuel efficiency, and travel preferences) and on third-party map, place, and fuel/charging data. We may add, change, or remove features at any time.
This is the most important section. By using the Services you acknowledge and agree that:
You accept full responsibility for your trip and for your own safety and that of your passengers and others.
The Services incorporate data and services from third parties, including mapping, routing, place, fuel-location, and EV-charging data providers. We do not control and are not responsible for the accuracy, availability, or completeness of third-party data, and such data may be out of date or incorrect. Your use of third-party services may also be subject to those providers’ own terms and policies.
The Services let you create and store content such as saved trips, notes, and photos (“Your Content”). You retain ownership of Your Content. You grant TrippApps a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display Your Content solely to operate, provide, and improve the Services for you. You are responsible for Your Content and represent that you have the rights to it and that it does not violate any law or the rights of others. If you send us feedback or suggestions, you grant us the right to use them without restriction or obligation to you.
You agree not to: use the Services for any unlawful purpose; copy, scrape, or harvest data from the Services except as expressly permitted; reverse engineer, interfere with, or disrupt the Services or their security; resell or commercially exploit the Services without our permission; or misuse the Services in any way that could harm TrippApps, other users, or third parties.
The Services, including their software, design, text, graphics, logos, and the TrippApps name and brand, are owned by TrippApps or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own personal, non-commercial trip planning, subject to these Terms. All rights not expressly granted are reserved.
If the Services offer paid features, subscriptions, or merchandise, additional terms (including pricing, billing, and fulfillment terms presented at the point of purchase) apply to those transactions and form part of these Terms. Taxes may apply.
The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade. TrippApps does not warrant that the Services will be uninterrupted, secure, error-free, or that any estimate, route, or data will be accurate or reliable. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
To the fullest extent permitted by law, TrippApps and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for personal injury or property damage, arising out of or relating to your use of (or inability to use) the Services, even if advised of the possibility of such damages. To the fullest extent permitted by law, TrippApps’s total liability for all claims relating to the Services will not exceed the greater of the amount you paid TrippApps in the twelve months before the claim, or USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless TrippApps and its owners, employees, and suppliers from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, Your Content, or your violation of these Terms or of any law or the rights of a third party.
You may stop using the Services and close your account at any time. We may suspend or terminate your access to the Services at any time if you violate these Terms or if we discontinue the Services. Provisions that by their nature should survive termination (including Sections 4, 6, 8, 10, 11, 12, and 14) will survive.
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as posting the updated Terms here with a new effective date or asking you to accept them again in the app. Your continued use of the Services after the changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You and TrippApps agree that any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.
These Terms are the entire agreement between you and TrippApps regarding the Services and supersede any prior agreements. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
